Pandora v. American Society of Composers, Authors and Publishers

6 F. Supp. 3d 317 (S.D.N.Y. 2014) aff’d, 785 F.3d 73 (2nd Cir. 2015)

Pandora was the result of the Music Genome Project, where different songs are assigned a value of 0 - 5 in hundreds of "genes" to determine which music a listener will like based on "seed" song(s). Other internet radio services use different methods to select songs -- Spotify can generate random playlists based on genre and decade, but relies heavily on social networking for playlists. Apple Music, in a throwback to the pre-internet days, is using actual human DJs.

This case was affirmed on appeal in May 2015.
