Section 1201 and the First Amendment

The Second Circuit considered whether a prohibition on posting DeCSS violated the First Amendment in U.S. v. Corley. The court upheld an order against linking to others' websites where DeCSS was available, making this one of the few court orders to ever ban not just posting content, but linking to it.

The Copyright Office has been granted rulemaking authority to grant exemptions to Section 1201's circumvention ban. Another such rulemaking was started in 2014 and as of 2015 is ongoing.
