Judge Kaplan compared Mannion's picture of Garnett to several other iconic photos, including Catch of the Day and Eisenstaedt's V-J Day in Times Square to illustrate the relevance of timing to a photograph's originality. In this case, originality in timing was less important than originality in subject, which Kaplan chose to illustrate with Puppies.
